Read News!: PDP heads to tribunal over Imo North by-election result; The PDP says it aims to contest the results of the Senate election in Imo North at the tribunal on December 5. The PDP Secretary of Government, Mr. Ogu Nwadike from Owerri, made this comment on Friday.
This was part of a statement. Nwadike pointed out the Party's decision to declare the APC (The All Progressive Congress) winner without a successful candidate was born of his dispute with the decision of the Independent National Electoral Commission (INEC).
According to him, without a candidate, a party should not be permitted to take part in an election.
He said it would be unconstitutional to pronounce the party the winner of the election if an electorate were rejected by a court of competent jurisdiction. Nwadike said the candidates for elections had been filed before and not after elections in accordance with the current electoral laws.
“It is unlawful and illegal to field a candidate for an election after the election and this is what we have gone to challenge at the tribunal because the PDP should be declared winner since the APC had no candidate before going into the election.
“It is sheer illegal holding a Certificate of Return (CoR) in reserve for a party that is still in court striving to determine who its candidate should be, almost two months after the election.
“We urge the judiciary to defend our constitution by resisting pressure to declare a person as candidate of an already concluded election.
“It’s on this note that the PDP and Chief Emmanuel Okewulonu, our candidate have taken an objection to the Election Petition Tribunal for the election to seek a redress for the wrongful declaration of APC as winner of the election, “ he said.
Nevertheless, Nwadike shared hope that the court would confirm the PDP as its real electoral winner and ensured its solid support for winning on a long-term basis.
A Federal High Court removed Mr. Frank Ibezim from the election on 4 December for the submission to INEC of a false paper.
