In the committal proceedings in suit no.FHC/ABJ/CS/760/2021, Abuja has granted Barrister Jimoh Ibrahim enrollment of order for publication of forms 48 and 49 and service of all other court's processes validly issued. Ibrahim has petitioned the court for committal proceedings to be served on the Asset Management Corporation of Nigeria (AMCON) Managing Director/CEO, Ahmed Lawal Kiru, Executive Director, Eberechuwkwu Uneze, and Executive Director, Aminu Ismail via publishing in national publications.
"Having considered that the defendants/alleged contemnors did not seek leave of the court to file appeal against the interlocutory decision of the court of March 9, 2022, the grounds of the appeal are grounds of facts, at best grounds of mixed law and facts," said the presiding judge, Justice O. E Abang, in his ruling.
"The court also took into account the fact that the defendants escaped personal service of form 48."
The court also ruled that because the respondents did not file a motion to stay execution of the March 9, 2022 order and appeal perse does not operate as a stay of execution, the applicants should publish forms 48 and 49, as well as other court processes to be lawfully issued in the matter, in two national daily newspapers, The Nation and The Punch.
.Upon publication, it shall constitute valid service of forms 48 and 49, as well as other court processes, to be lawfully issued in the subject of the 1st to 12th defendants, as well as the senior officers of the 1st defendant, who were cited for contempt by the court's order dated March 9, 2022.
It should be noted that the court had ordered committal proceedings against the Managing Director of Asset Management Corporation of Nigeria (AMCON), Ahmed Lawal Kuru, for allegedly taking over firms owned by businessman Jimoh Ibrahim in violation of a court order. In a judgement on an ex-parte request made by Victor Ogbonna, counsel to Mr Ibrahim and others, Justice Okon Abang also instructed the plaintiffs to initiate committal proceedings against the Director General, Bureau of Public Enterprises.
